Breaking: Court invalidates FG’s permit suspension on AIT, Raypower

The Justice Inyang Ekwo-led Federal High Court sitting in Abuja has, Friday, invalidates the suspension of the operating license of Daar Communications PLC, operator of AIT and Ray Power.

The National Broadcasting Commission, NBC, had, Thursday, suspended the working permit of the Daar Communications PLC, administrator of AIT and Ray Power over supposed rupture of the NBC’s communicating code.

Equity Inyang Ekwo, while conveying the request, gave the federal government and NBC till May 30, 2019, to return the restriction on Daar Communications PLC.

Equity Ekwo had requested the National Broadcasting Commission (NBC), the Federal Ministry of Information and Culture and the Attorney General of the Federation to show up before the court on Thursday, June 13 to show cause why the motion on notice by Daar Communications PLC, challenging the ban should not be granted.

Review that while declaring the restriction on Daar Communications in Abuja on Thursday, the Director General of the NBC, Dr. Modibbo Kawu had said that the choice depended on the infringement of the broadcasting code by the stations which is sponsored by arrangements of Section 10 of the Third Schedule of the NBC Act Cap N11 Laws of the Federation of Nigeria, 2004.

Aside from disregarding communicating code, he said the choice was likewise taken for the disappointment of the communicate stations to pay their license charges as when due, even steady cautioning to the organization to fall in the line of caution.

Be that as it may, In an ex parte application, Daar Communications PLC, had, through its legal counselor, Mike Ozekhome (SAN), on Thursday, requested that the court request the Commission to return its boycott.

Daar Communications PLC, In the suit against the NBC, the Federal Ministry of Information and Culture, and the Attorney General of the Federation, Daar asserted that did not rupture any communicate code.

It requested that the court allow its pray in “limiting the respondents from blocking, sticking, preventing expelling from air or potentially meddling with the wireless transmissions of the offended party/candidate (Daar Plc) in any capacity and way anyway called from attacking the premises of the offended party/candidate (Daar Plc) or shutting down, Viet armies, the said premises, its tasks or communicate administrations, pending the conference and assurance of the movement on notice documented alongside this application.”
